Increasingly, tyrannical actions by Democrat governors and mayors are being successfully challenged court by liberty-minded Americans who are working diligently to get back freedoms stolen under the guise of the ‘coronavirus pandemic.’
The most recent case in point: A county judge in Oregon has now declared that Gov. Kate Brown’s (above) perpetual shutdown order is “null and void” because it was never approved by the state legislature.
Baker County Circuit Judge Matthew Shirtcliff issued his ruling Monday in response to a lawsuit brought by churches who claimed that social-distancing restrictions preventing in-church services were unconstitutional.
The suit also argued that emergency powers only last for a month and after that Brown would have needed legislative approval, and Shirtcliff agreed.
Because the queen isn’t used to having her orders questioned, much less rescinded, Brown said her administration would immediately appeal the ruling to the state Supreme Court because of ‘safety’ concerns.
“This will ensure we can continue to safeguard the health of all Oregonians — including frontline health care workers, those living in nursing homes, workers in agriculture and food processing plants, and Oregonians with underlying health conditions –– while the legal process moves forward,” she said in a statement.
Ray Hacke, the attorney who represented the plaintiffs in the case, said the ruling not only invalidates the church restrictions, it invalidates the entire stay-at-home order.
“The stay-at-home order is no longer in effect. It is invalidated. If people want to get their haircut, they can. They can leave their home for any reason whether it’s deemed essential in the eye of the state or not,” he told The Associated Press.
“Praise God. I’m excited, and I’m glad that the judge saw that there are limitations on the governor’s power, even in the midst of emergencies,” he added.
A federal judge in Kentucky recently ruled in favor of churches in the state that also sued because Democratic Gov. Andy Beshear’s stay-at-home order also forbids in-person church services.
Americans are rightfully becoming increasingly frustrated by extended shutdown orders that make no sense at this point and are depriving them of their constitutional rights and liberties.
